Privacy Policy

This page explains which personal data I process in connection with smartchoice.dev, for what purpose, on what legal basis, and what rights you have.
1. Controller
The controller is Smart Choice Bolesław Badziąg, ul. Folwarczna 23B, 84-207 Bojano, Poland, tax ID (NIP) 9581251173, REGON 220150798.

I have not appointed a data protection officer (I am not required to).
2. Hosting and server logs
The website, the contact form and the kontakt@smartchoice.dev mailbox run on servers of the hosting provider cal.pl, operated by INFOCAL sp. z o.o., ul. Jana Henryka Dąbrowskiego 77A, 60-529 Poznań, Poland (KRS 0000730688). The servers are located in a data centre in Germany (EU). The provider processes data on my behalf under a data processing agreement (Art. 28 GDPR).
On every visit the server automatically logs: IP address, date and time, the requested page, the response code, browser and operating system (User-Agent) and the referring page. I do this to keep the website secure and working properly (Art. 6(1)(f) GDPR). Logs are kept for about 6 days (the server archives the logs daily and keeps the archives of the last 5 days) and then deleted. The hosting panel also builds monthly aggregate traffic statistics from the logs (Webalizer), which may include the most frequent IP addresses. They are available only to me and remain on the server for as long as I use the hosting service.
The hosting provider uses bot protection which, on a first visit, may briefly show a verification screen (“One moment, please…”).
3. Contact form and e-mail
When you send the form, I process your name, e-mail address, company name (if provided) and your message. The form also records when the page was opened and contains a hidden anti-spam field; these are not stored beyond the message itself. The message is sent as an e-mail from the hosting server to kontakt@smartchoice.dev. The form does not store data in any database. The mailbox is operated on cal.pl servers.
I process data in the same way when you e-mail kontakt@smartchoice.dev directly or call me.
Purpose and legal basis: answering your enquiry and taking steps prior to entering into a contract (Art. 6(1)(b) GDPR), and otherwise my legitimate interest in handling correspondence (Art. 6(1)(f) GDPR). Providing data is voluntary, but without an e-mail address I cannot reply.
Retention: for the duration of our correspondence and, if no cooperation follows, for 12 months after the last message. If we enter into a contract, I keep the data for its term, the limitation period for claims and as long as tax law requires.
4. Analytics: Google Analytics (only with consent)
On your first visit to the homepage I ask for your consent to analytics. Until you give it, the Google Analytics script is not loaded at all. By default I use Google Consent Mode with analytics and advertising storage denied.
Google Analytics 4 (ID G-GCWRZ2G9JX), provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. With your consent, Google Analytics sets cookies (_ga, _ga_*) and collects information about pages visited, visit duration, approximate location, device and browser. Google Analytics 4 does not store full IP addresses. Data may be transferred to Google LLC in the USA; Google LLC is certified under the EU-U.S. Data Privacy Framework (Art. 45 GDPR). Data in Google Analytics is kept for 14 months (the data retention setting in Google Analytics 4). The _ga cookies expire after at most 2 years.
Legal basis: your consent (Art. 6(1)(a) GDPR, Art. 399 of the Polish Electronic Communications Law / § 25 TDDDG). You can withdraw it at any time with the button below or via “Analytics settings” in the homepage footer. Withdrawal does not affect the lawfulness of processing before it.
5. Cookies and browser storage
smartchoice-analytics(localStorage, no expiry): remembers your choice in the consent dialog. It is necessary so that I do not ask you on every visit._ga,_ga_*(cookies, up to 2 years): Google Analytics, only after consent.
The website does not use advertising cookies or third-party tracking cookies.
6. Fonts
The Archivo typeface is stored on this website’s server and loaded together with it. The website does not connect to Google Fonts or any other external font servers.
7. Links to other services
The website contains plain links to LinkedIn. Data is sent to LinkedIn only when you click such a link, under LinkedIn’s privacy policy.
8. Recipients
Data may be received by the hosting provider (cal.pl), Google (only with analytics consent) and authorities entitled by law. I do not sell data and do not use it for profiling or automated decision-making.
9. Your rights
You have the right to access your data, to rectification, erasure, restriction of processing, data portability, to object to processing based on legitimate interest, and to withdraw consent at any time. Write to kontakt@smartchoice.dev.
You also have the right to lodge a complaint with the supervisory authority: the President of the Personal Data Protection Office (UODO), ul. Stawki 2, 00-193 Warsaw, Poland, uodo.gov.pl, or with the authority in your country of residence.
10. Changes
If the way I process data changes, I will update this page and the date at the top.
